These Terms and Conditions (“Terms”) govern your use of the GoShisha website (“Website”) and the booking, delivery, staffing, event and venue management services provided by GoShisha (“GoShisha”, “we”, “us” or “our”) in India.
By using our Website or Services, requesting a quotation, making a booking or entering into a venue partnership, you agree to these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use our Website or Services.
These Terms apply to private customers, corporate clients, event organizers, hotels, restaurants, cafés, lounges and other venue partners.
We may update these Terms from time to time. The Terms applicable to your Booking or partnership will be the version published on the Website at the time the transaction is confirmed, unless otherwise agreed in writing.
For the purpose of these Terms:
3.1 Compliance with Indian Law
The sale, supply, possession and use of tobacco products and the operation of hookah or shisha services in India are subject to central, state and local laws.
The Cigarettes and Other Tobacco Products Act, 2003 (COTPA) and other applicable laws may restrict smoking in public places. Certain states and local authorities may also restrict or prohibit hookah or shisha services, including services involving non-tobacco or herbal products.
GoShisha will provide Services only where they are legally permitted. We reserve the right to refuse, suspend, modify or cancel a Booking if applicable law, licensing requirements or directions from a government or local authority prevent us from providing the Services.
The Client and Venue Partner are responsible for ensuring that the proposed event or venue is legally permitted to host the requested Services.
3.2 Age Requirement
Our Services may involve tobacco or nicotine products. We will not sell, supply or provide such products to anyone below 18 years of age, or any higher minimum age required by applicable law.
GoShisha or its Shisha Masters may request valid government-issued photo identification to verify age. We may refuse service if satisfactory proof of age is not provided.
3.3 Responsibility for Minors
The Client and Venue Partner must take reasonable steps to ensure that minors do not access, purchase or consume tobacco or nicotine products at an event or venue.
3.4 Legal Capacity
A Booking or partnership agreement may only be made by a person who has the legal capacity to enter into a contract under applicable Indian law.
GoShisha may provide services including:
The exact Services, quantity, timing, location and applicable charges will be stated in the relevant Quotation or Booking confirmation.
GoShisha may use employees, contractors or third-party service providers to deliver the Services where appropriate.
5.1 Quotations
All Quotations are subject to availability and may be valid only for the period stated in the Quotation.
A Quotation does not guarantee availability until the Booking has been confirmed by GoShisha.
5.2 Booking Confirmation
A Booking will be considered confirmed only after:
GoShisha may decline a Booking where the requested Services are unavailable, legally restricted or otherwise cannot be provided safely.
5.3 Changes to a Booking
Any request to change the date, time, location, number of guests, Services or Equipment is subject to availability and may result in additional charges.
All prices are quoted in Indian Rupees (INR) unless otherwise stated.
Prices are exclusive of GST and other applicable taxes unless the Quotation specifically states otherwise. Applicable taxes will be charged in accordance with Indian tax law.
Payment may be made through:
The Client must make payments within the time stated in the Quotation or Booking confirmation.
If payment is not received on time, GoShisha may suspend or cancel the Booking.
Cancellation and rescheduling terms will be communicated at the time of Booking and may depend on the type of Service, event size and notice period.
Where applicable:
The cancellation terms given with your booking are more important than these general rules.
Where GoShisha supplies Equipment, the Client or Venue Partner must use it responsibly and only for its intended purpose.
The Client or Venue Partner may be responsible for the cost of repairing or replacing Equipment that is lost, stolen or damaged due to misuse, negligence or unauthorized use.
Where applicable, GoShisha may collect a refundable security deposit before providing Equipment.
The Equipment remains the property of GoShisha unless ownership is expressly transferred in writing.
The Client must:
The Client must not request or instruct GoShisha staff to provide Services in a manner that violates Applicable Laws or safety requirements.
Venue Partners must get and keep all licenses, permissions, and approvals needed to legally run or host shisha-related services at their location.
This may include, where applicable, excise, municipal, health, fire, trade or other regulatory approvals.
The Venue Partner must provide evidence of relevant approvals when reasonably requested by GoShisha.
GoShisha may refuse, suspend or stop Services if the required approvals are not available or if providing the Services may breach Applicable Laws.
Venue Partners must also comply with all applicable requirements relating to tobacco use, smoking areas, age restrictions, health warnings, fire safety and customer safety.
Smoking and tobacco use are harmful to health.
GoShisha will provide or display applicable statutory health warnings and comply with relevant legal requirements relating to tobacco products.
By using our Services, the Client and guests acknowledge the health risks associated with smoking and tobacco use and voluntarily choose to use the Services.
Pregnant individuals and people with medical conditions should consult a qualified healthcare professional before using tobacco or nicotine products.
Clients and guests must follow all safety instructions provided by GoShisha staff.
GoShisha will not be responsible for injury, fire, loss or property damage caused by misuse of Equipment, unsafe conduct, failure to follow safety instructions or actions outside GoShisha’s reasonable control, except to the extent such loss or damage is caused by GoShisha’s negligence, wilful misconduct or other liability that cannot legally be excluded.
All content on the Website, including text, graphics, logos, photographs, videos, designs, trademarks, and other materials, belongs to GoShisha or its licensors unless stated otherwise.
You may not copy, reproduce, modify, distribute, publish or commercially use our content without prior written permission.
Any use of the GoShisha name, logo, branding or other intellectual property without permission is prohibited.
Where a Client provides photographs, videos, logos, reviews, testimonials or other content to GoShisha, the Client confirms that they have the necessary rights and permissions to provide that content.
GoShisha will use such content only in accordance with the agreed purpose and applicable privacy laws.
GoShisha will not use identifiable customer photographs or videos for marketing purposes where consent is legally required unless the necessary consent has been obtained.
GoShisha may collect and process personal information required to provide the Website and Services, process Bookings, communicate with Clients, make payments and meet legal or regulatory requirements.
Personal data will be handled in accordance with GoShisha’s Privacy Policy and applicable Indian data protection and privacy laws, including the Digital Personal Data Protection Act, 2023 (DPDP Act), to the extent applicable.
When you use our Services, you agree that we may use your personal information for business and service purposes, as explained in our Privacy Policy.

GoShisha may update these Terms from time to time to reflect changes in our Services, business practices or Applicable Laws.
The updated version will be published on the Website with a revised Last Updated date.
The Terms applicable to a confirmed Booking will generally be the version in effect when the Booking was confirmed, unless a later change is required by law or otherwise agreed between the parties.
